Changes to Regulations for Construction Works

As of the 1st January 2018, the Water Environment (Miscellaneous) (Scotland) Regulations 2017 have come into force. This new legislation modifies some of the General Binding Rules (GBRs) and requires a CAR licence to be in place prior to commencing construction works for any projects which are:

  • Larger than 4 hectares;

  • With access road longer than 5 km; or

  • With any area of more than 1 hectare or length >500m with slope in excess of 25 degrees.

It also revokes the Water Environment (Oil Storage) (Scotland) Regulations 2006. ​In order to obtain the aforementioned licence, applicants will have to present a Pollution Prevention Plan (PPP) during the pre-construction phase, detailing the site characteristics, water environment receptors and Construction Sustainable Drainage System (Construction SuDS). CAR licences applications typically have a 4 month determination period and could therefore have a significant impact on project timescales.
